CMS OPO Metric Bias Against Large OPOs Research Summary

Continuing research into the controversial Centers for Medicare and Medicaid Services (CMS) metric for ranking the performance of Organ Procurement Organizations (OPOs) provides more evidence that unless CMS changes course, the metric will give biased results that will not withstand legal scrutiny.

Because CMS’s new Final Rule is certain to produce inaccurate rankings, any attempt by CMS to decertify OPOs based on this metric will likely result in lengthy appeals in federal court and successful litigation to overturn CMS’ action against OPOs. Given the certainty of failure, Science in Donation & Transplant is renewing its call for CMS to stop ignoring the scientific evidence.
